Creating Space

These terms are an agreement between you and Lightbulb Moment Labs, Inc., a Texas corporation ("we", "us", "our"), covering your use of the Creating Space app.
By downloading or using Creating Space, you agree to these terms. If you do not agree, do not use the app.

1. Who can use Creating Space
You must be at least 13 years old. Where your local law sets a higher minimum age for agreeing to terms like these or for consenting to digital services, you must meet that age instead.
If you are under the age of majority where you live, you confirm that a parent or guardian has reviewed and agreed to these terms with you.
2. What Creating Space is
Creating Space is a focus and screen time app for your own device. It lets you run focus sessions and set recurring protected hours, during which apps you choose are blocked, and it fills in a procedurally generated night sky as you keep going.
Creating Space needs a paid plan. The app is free to download and every subscription starts with a 7 day free trial, but once that trial ends a plan is required to keep using it. There is no free tier. Section 6 covers the three products and how they are billed.
It is a tool for managing your own phone. It is not a parental control product, it is not for monitoring or restricting anyone else's device, and it may not be used that way.
3. What Creating Space is not
Please read this section. It is short and it matters.
It is not a medical device and it is not healthcare. Creating Space does not diagnose, treat, cure, or prevent any condition, including attention disorders, anxiety, or compulsive phone use. Nothing in the app is medical, psychological, or clinical advice. If you are concerned about your relationship with your phone or your mental health, please speak to a qualified professional.
Blocking is not a security control. The app asks iOS to shield apps you selected. This is a tool for helping you keep a commitment to yourself, not a lock. It can be bypassed, including by changing your own settings, and it does not protect your device, your data, or anyone else from anything. Do not rely on it where a real safeguard is needed.
You choose what gets blocked, and you are responsible for that choice. Creating Space blocks exactly what you select, for exactly the window you set. Take care not to block something you may urgently need, such as a phone, messaging, maps, transit, banking, or medical app. Consider what you might need before a long session or an overnight schedule begins. We are not responsible for consequences of apps you chose to block being blocked.
Emergency calling is not affected by Creating Space, but you should still keep this in mind when configuring long blocking windows.
4. Your licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Creating Space on Apple devices you own or control, in line with the App Store Terms of Service and these terms.
You may not:
- copy, modify, or create derivative works of the app
- reverse engineer, decompile, or attempt to extract the source code, except where that restriction is prohibited by law
- rent, lease, lend, sell, redistribute, or sublicense the app
- use the app to manage, monitor, or restrict a device belonging to another adult, or a child's device other than through Apple's own Family Sharing features
- use the app for any unlawful purpose
5. Your content
The words you write in the app, including the reason you type in "Creating space to ___", belong to you. They stay on your device and, if you use iCloud, in your own private iCloud storage. We do not collect them, cannot read them, and claim no rights over them. See the Privacy Policy for the detail.
6. Purchases
Creating Space is free to download, and a paid plan is required to use it. Every subscription starts with a 7 day free trial, and if you cancel before it ends you are charged nothing.
A plan covers the whole app: focus sessions, the schedules that protect recurring hours, the blocking that enforces both, your streak, your record, and the sky.
There are three products. All of them are sold through Apple and billed to your Apple Account:
- Creating Space+ Monthly, an auto renewing subscription covering one month, offered with a 7 day free trial
- Creating Space+ Annual, an auto renewing subscription covering one year, offered with a 7 day free trial
- Creating Space+ Lifetime, a one time purchase that does not renew
Subscriptions renew automatically. A subscription renews at the end of each period unless you cancel it at least 24 hours before that period ends, and your Apple Account is charged for the renewal.
You manage and cancel subscriptions in your Apple Account settings, not through us. We cannot cancel, pause, refund, or change a subscription for you.
If you buy a subscription while a free trial is running, the unused part of that trial is forfeited.
Apple processes every purchase. We never see your card number, your billing address, or any other payment detail.
Refunds are handled by Apple, under Apple's terms. Refund requests go to Apple, not to us.
Prices are shown in the App Store and vary by region. We may change prices, and any change to the price of a subscription is subject to Apple's rules and to your consent where Apple requires it.
7. Availability and changes
We may update, change, or discontinue Creating Space or any of its features at any time. We may also stop supporting older versions of iOS.
We do not promise the app will be uninterrupted or error free, and features that rely on Apple's frameworks, including Screen Time blocking, notifications, Live Activities, and iCloud sync, depend on Apple's systems working as documented.
8. Your data and backups
Your progress lives on your device and, if you use iCloud, in your own private iCloud storage. We hold no copy of it and cannot recover it for you.
If you delete the app, reset your universe from within it, lose your device, or remove the iCloud data, that information is gone as far as we are concerned. Keeping a device backup is your responsibility.
9. Disclaimer of warranties
To the fullest extent permitted by law, Creating Space is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the app will meet your requirements, that it will be uninterrupted, timely, secure, or error free, or that any blocking will occur without failure.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.
10. Limitation of liability
To the fullest extent permitted by law, Lightbulb Moment Labs, Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or missed opportunities, arising out of or relating to your use of or inability to use Creating Space, whether based in contract, tort, negligence, strict liability, or otherwise, and whether or not we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for all claims relating to Creating Space will not exceed the greater of the amount you paid us for the app in the twelve months before the claim, or twenty five United States dollars (US$25.00).
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
11. Indemnity
You agree to indemnify and hold harmless Lightbulb Moment Labs, Inc. from any claims, damages, losses, liabilities, and expenses, including reasonable legal fees, arising out of your use of Creating Space, your violation of these terms, or your violation of any law or the rights of a third party.
12. Termination
These terms apply until terminated. Your licence ends automatically if you fail to comply with them, and you may end it at any time by deleting the app. Sections 3, 5, 6, and 8 through 14 survive termination.
13. Apple
You acknowledge that these terms are between you and us, not with Apple, and that Apple is not responsible for Creating Space or its content.
- Apple has no obligation to furnish any maintenance or support for Creating Space.
- If Creating Space fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claim by you or a third party relating to Creating Space, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- Apple is not responsible for the investigation, defence, settlement, or discharge of any third party claim that Creating Space infringes intellectual property rights.
- You represent that you are not located in a country subject to a United States government embargo or designated as a "terrorist supporting" country, and that you are not on any United States government list of prohibited or restricted parties.
- Apple and its subsidiaries are third party beneficiaries of these terms, and upon your acceptance, Apple will have the right to enforce these terms against you as a third party beneficiary.
14. Governing law and disputes
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws rules.
You and we agree that any dispute arising out of or relating to these terms or Creating Space will be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.
Nothing in this section removes any right you have under the mandatory consumer protection laws of the country where you live, including any right to bring proceedings in your local courts.
15. Changes to these terms
We may update these terms. The current version will always be at creatingspace.app/terms with its "Last updated" date. Material changes will also be surfaced in the app. Continuing to use Creating Space after a change means you accept the updated terms.
